These Terms and Conditions ("Terms") govern your access to and use of the Friendfinityâ„¢ website, applications, telephone services, subscriptions, products, features, and related services (collectively, the "Services") provided by Friendfinityâ„¢ ("Friendfinityâ„¢," "we," "us," or "our").

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, you should not access or use the Services.

1. Description of the Services

Friendfinityâ„¢ is a subscription-based conversational voice service that allows users to have private conversations with Emily, an artificial intelligence conversational companion.

The Services are designed to provide:

  • Private voice conversations
  • General conversation and companionship
  • Conversation-based reflection
  • Practice conversations
  • Personal discussion and thought organization
  • Subscription-based conversational services

Friendfinityâ„¢ is designed to provide a place to talk. It is not intended to replace relationships with family, friends, healthcare providers, therapists, counselors, or other qualified professionals.

We may modify, improve, suspend, or discontinue any aspect of the Services at any time.

2. Conversation Recall

Some Friendfinityâ„¢ memberships include Conversation Recall.

Conversation Recall allows Emily to remember certain information from previous conversations so future conversations may continue with greater continuity and context.

Depending on your membership, Conversation Recall may include information such as:

  • Conversation summaries
  • Topics previously discussed
  • User preferences
  • Personalized memory entries
  • Context necessary to continue future conversations

Conversation Recall is available only for membership plans that specifically include this feature.

Friendfinity Liteâ„¢ and Friendfinityâ„¢ begin each conversation with a fresh start and do not provide Conversation Recall.

3. Friendfinityâ„¢ Is Not Medical Care

Friendfinityâ„¢ is not a healthcare provider.

Emily is not a physician, psychologist, psychiatrist, therapist, counselor, or other licensed healthcare professional.

The Services:

  • do not diagnose medical or mental health conditions
  • do not provide medical advice
  • do not prescribe treatment
  • do not replace professional care

If you believe you are experiencing a medical emergency or mental health crisis, immediately contact:

  • 911
  • Your local emergency services
  • Your healthcare provider
  • 988 Suicide & Crisis Lifeline (United States)

4. Eligibility

You must be at least 18 years of age to create an account or purchase a subscription.

If applicable law permits younger users, they may use the Services only with the consent and supervision of a parent or legal guardian.

By using Friendfinityâ„¢, you represent that you satisfy these eligibility requirements.

5. Accounts

Certain Services require an account.

You agree to:

  • provide accurate information
  • maintain current account information
  • safeguard your login credentials
  • promptly notify us of unauthorized account access

You are responsible for activity occurring under your account.

6. Subscriptions and Payments

Friendfinityâ„¢ offers subscription memberships that include monthly conversation time.

Subscription plans may include, among others:

  • Friendfinity Liteâ„¢
  • Friendfinityâ„¢
  • Friendfinity+â„¢

By purchasing a subscription, you authorize Friendfinityâ„¢ to charge your selected payment method.

Subscriptions automatically renew until canceled.

Current pricing is displayed at the time of purchase.

Refunds and cancellations are governed by our separate Return and Refund Policy.

7. Acceptable Use

You agree not to use Friendfinityâ„¢:

  • for unlawful purposes
  • to harass, threaten, or abuse others
  • to attempt to exploit, manipulate, or compromise the AI system
  • to transmit malicious software or harmful content
  • to interfere with operation of the Services
  • to impersonate another individual

We reserve the right to suspend or terminate accounts that violate these Terms.

8. Communications

By creating an account or purchasing a subscription, you may receive:

  • account notifications
  • billing notices
  • service announcements
  • security notifications
  • product updates

If you separately opt into marketing communications, you may also receive promotional emails or SMS messages.

Marketing consent is optional and may be withdrawn at any time.

9. Artificial Intelligence

Emily is powered by artificial intelligence.

Although we continually improve the Service:

  • responses may occasionally be inaccurate
  • Emily may misunderstand information
  • conversations may contain mistakes
  • AI-generated responses should not be relied upon for legal, medical, financial, or other professional advice

Users remain responsible for decisions made using information provided during conversations.

10. Intellectual Property

All Friendfinityâ„¢ software, technology, voice systems, branding, logos, trademarks, content, and related materials remain the exclusive property of Friendfinityâ„¢ and its licensors.

You may not:

  • copy
  • reproduce
  • modify
  • distribute
  • reverse engineer
  • sublicense
  • resell

any portion of the Services without our prior written permission.

11. Privacy

Your use of Friendfinityâ„¢ is governed by our Privacy Policy.

By using the Services, you acknowledge that Friendfinityâ„¢ may collect, store, and process personal information as described in the Privacy Policy, including information necessary to provide Conversation Recall for eligible subscription plans.

12. Availability of Services

Friendfinityâ„¢ strives to provide reliable service but does not guarantee uninterrupted availability.

Services may occasionally be unavailable due to:

  • maintenance
  • upgrades
  • telecommunications outages
  • third-party service interruptions
  • circumstances beyond our reasonable control

13. Disclaimer of Warranties

The Services are provided "AS IS" and "AS AVAILABLE."

To the fullest extent permitted by law, Friendfinityâ„¢ disclaims all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability.

14. Limitation of Liability

To the fullest extent permitted by law, Friendfinityâ„¢ shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or relating to your use of the Services.

This includes, without limitation:

  • emotional distress
  • interruption of service
  • loss of conversation history
  • loss of data
  • reliance upon AI-generated responses
  • inability to access the Services

Your use of Friendfinityâ„¢ is at your own risk.

15. Suspension and Termination

We may suspend or terminate your account if you violate these Terms or engage in activity that threatens the integrity or security of the Services.

You may stop using Friendfinityâ„¢ at any time and may cancel your subscription in accordance with our Return and Refund Policy.

16. Governing Law

These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles.

Any legal dispute arising under these Terms shall be resolved in the appropriate state or federal courts located in Arizona unless otherwise required by law.

17. Changes to These Terms

We may revise these Terms periodically.

The updated version will be posted on our website with a revised Last Updated date.

Your continued use of Friendfinityâ„¢ after revised Terms become effective constitutes acceptance of those changes.
